1. Definitions
- "We", "us", "our" refer to HiFlights Ltd, a company registered in England and Wales under company number 14781289 with its registered office at 36 Northwick Road, Evesham, Worcestershire, WR11 3AL.
- "You", "your" refer to all persons named on the booking.
- "Booking" refers to your confirmed purchase of travel services from us, including flights and/or car hire.
- "Airline" refers to the flight provider fulfilling the air travel portion of your booking.
- "Car Hire Provider" refers to the company supplying the vehicle for the car hire portion of your booking.
- “Supplier”, “Suppliers” refers to one, multiple or a combination of Airline and/or Car Hire Providers.
- “Flight Only” refers to a booking where only a flight, or multiple flights, are purchased.
- "Package" refers to a combination of at least two travel services (e.g. flight and car hire) purchased together, forming a single booking as defined by The Package Travel and Linked Travel Arrangements Regulations 2018.
- "Linked Travel Arrangement" (LTA) refers to two or more travel services purchased separately but connected in time or purpose, which may not offer the same legal protection as a Package.
2. Scope of These Terms
These Terms and Conditions govern your relationship with HiFlights Ltd, whether you book a flight only or a package consisting of a flight and car hire. In cases where your booking meets the criteria for a Package under the Package Travel and Linked Travel Arrangements Regulations 2018 (“The Regulations”), additional rights and protections apply to you, as explained in this document.
Important:
- Instalment payment options are only available for bookings that include both flight and car hire.
- All payments must be completed before the date of travel.
- By making a booking, you accept these Terms and Conditions and, where applicable, the terms of the Airlines and Car Hire Providers.
3. Our Role as Agent
We act as an agent for the Airline and the Car Hire Provider. This means that your contract for the provision your booking is with the suppliers. We do not accept liability for the performance of these services. However, when you book both a flight and car hire in a single transaction with us, you may be purchasing a Package, and in that case, we are responsible under The Regulations for the proper performance of the package as a whole.
4. Your Contract With Us
When making a booking you will enter into a contract with us. Your booking is subject to these Terms & Conditions which we advise you to read carefully prior to booking. All bookings are subject to availability with the suppliers. Upon a successful booking we will email written confirmation to you with the acceptance of your booking. These terms apply to all bookings and are legally binding.
5. Your Contracts With Suppliers
Separate contracts are created between you and each service provider. Their own terms and conditions will apply to the provision of services. These are made available to you prior to booking via our website. You must read and accept their terms before confirming your booking. These terms will include policies on check-in times, baggage allowance, vehicle rental conditions, and cancellation fees. As an agent we accept no responsibility for the acts or omissions of the Supplier/Principal.
6. Pricing
Prices are provided in real-time and are subject to change until your booking is confirmed. The final price is locked only when your booking is successfully processed. We do not guarantee the availability of any price advertised on our website prior to confirmation.
7. Booking Accuracy
You are responsible for ensuring that all details submitted during the booking process are accurate, including the full names of travellers (as per passports), travel dates, and destination details. Any changes after booking will be subject to the service provider’s amendment fees plus our administration fee of £10.00 per person.
The booking details provided to us will be passed on only to the relevant supplier, or other persons necessary for the fulfilment of your booking. This may include public authorities such as customs or immigration if required by them, or as required by law. In making your booking you consent to this information being passed on to the relevant persons.
8. Payments & Instalment Options
Instalment payments are only available for bookings that include both flight and car hire and are considered a Package.
- Instalments will be collected monthly until the full balance is cleared.
- Your first instalment is required at the time of booking.
- The full balance must be paid at least 15 days before the travel date.
- Missed or late payments may result in cancellation, with applicable fees (see Section 9).
- Payments are accepted via Credit or Debit Card only.
- If your booking does not include both flight and car hire, the full balance must be paid at the time of booking.
9. Missed or Late Payments
If we are unable to collect a scheduled payment, we will retry the next day. If payment remains outstanding after 14 days, we reserve the right to cancel your booking.
- A £20.00 cancellation fee per person applies.
- Refunds (minus fees) will be returned to the original payment card. If the card has expired, contact Customer Services.
- Cancellations will be subject to Supplier Terms & Conditions. Any cancellation charges will be netted from your refund.
- Prices may vary if you attempt to rebook later.
10. Cancellations by You
You may cancel your booking at any time before the final payment deadline.
- A £20.00 per person cancellation fee will apply.
- Refunds of any additional amounts paid (minus fees) will be returned to your card.
- Cancellations will be subject to Supplier Terms & Conditions. Any cancellation charges will be netted from your refund.
11. Cancellations by Us or the Suppliers
We may cancel your booking for non-payment (see Section 9). Suppliers may cancel your services under their own terms. If this happens:
- You will be entitled to a full refund of all monies paid.
- We accept no liability for changes or cancellations made by service providers, except where you have booked a Package. In this case, we will ensure you receive suitable alternative arrangements or a refund, as required by The Regulations.
12. Alterations by You
We will aim to accommodate reasonable changes made at least 3 weeks before your final payment deadline.
- All changes must be made by the Lead Booker.
- Increases in booking value will be distributed across future instalments or due immediately.
- Reductions will result in adjusted instalments or a refund, where applicable.
- A £10.00 amendment fee per person will apply.
13. Your Responsibilities
You must:
- Behave safely and responsibly.
- Comply with the Airline and Car Hire Provider’s rules.
- Arrive on time for your flight and vehicle collection.
- Carry correct documentation, including passports and licences.
- Take out suitable travel insurance covering flight and car hire risks (e.g. cancellations, delays, damage).
14. Our Responsibilities
We will act with reasonable care in arranging your travel services and comply with all applicable consumer laws. If you book a Package, we are responsible for the overall delivery of the travel services. In the event of a service failure, we will assist in resolving the issue and, where necessary, provide alternative arrangements or compensation, in line with The Regulations.
15. Financial Protection
We are committed to consumer financial protection. All bookings made with us are fully insured for monies paid towards your booking. Your money is fully protected and is held within an independent Trust Account, managed by Protected Trust Services Ltd of 307-315 Holdenhurst Rd, Boscombe, Bournemouth BH8 8BX and its Trustees, chartered accountants - Elman Wall Ltd of 8th Floor, Becket House, 36 Old Jewry, London EC2R 8DD.
16. Third-Party Rights
No person who is not a party to this contract shall have any rights under the Contracts (Rights of Third Parties) Act 1999.
17. Governing Law
These Terms shall be governed by the laws of England and Wales. Any disputes will be dealt with exclusively by the courts of England and Wales.
18. Changes to These Terms
We reserve the right to update these Terms and Conditions without prior notice. When updated, the new terms will be published on our website and apply to future bookings. For existing bookings, only the terms in place at the time of booking will apply unless a regulatory or legal change requires otherwise.
